O R D E R

% 15.11.2016 The petitioner has filed the present petition under Section 9 of the Arbitration and Conciliation Act, 1996 (hereinafter 'the Act'), inter alia, praying for an order staying the effect and operation of the letters dated 01.09.2015 and 07/08.09.2015 issued by the respondent threatening to recover the amount of `1,79,07,402/- from the security deposit made by the petitioner. On 16.09.2015, an ad interim order was passed restraining the respondent from invoking the bank guarantees specified therein. Thereafter, the said order was modified on 05.11.2015.

In view of the fact that the Sole Arbitrator has been appointed, it would be appropriate if the present petition is considered as an application under Section 17 of the Act by the Sole Arbitrator. It is, accordingly, so directed. The petitioner shall file a copy of the petition along with the documents as well as orders passed in this petition before the Sole Arbitrator

within a period of one week from today. The interim orders passed shall continue till further orders are passed by the Arbitrator and shall be subject to any order(s) so passed by the Arbitrator.

The petition is disposed of.
