1. The mediation report dated 6th December 2016 states that the dispute could not be settled.

2. It is directed that within two weeks from today, the Petitioner will send a notice to the Respondent invoking the arbitration clause and seeking reference of the disputes between the parties to arbitration. If there is no response to the said notice within a period of two weeks after the receipt thereof by the Respondent, the Petitioner should file within a further period of 30 days an appropriate petition for the appointment of an Arbitrator.

3. Subject to the above steps being taken, within the time as directed, the interim order passed by this Court on 5th October, 2015 is directed to O.M.P.(I) 554/2015

continue, till such time, the Arbitrator appointed passes an order varying, modifying or vacating the said interim order in accordance with law in an application that may be filed by either party under Section 17 of the Arbitration and Conciliation Act 1996.
