O R D E R

% 17.07.2018 After some hearing, learned counsel for the petitioner submits, on instructions, that he may be permitted to withdraw the present petition whereby a prayer was made for cancelling the order dated 27.08.2015 of the court of Sessions granting bail to the second respondent on bail application no. 939/2015 in case FIR No. 888/2013, P.S.

Mehrauli involving offences punishable under Sections 420/471/448/468/34 IPC.

He, however, submitted that directions may be given that the criminal case be proceeded with expeditiously inasmuch as the charge-sheet was submitted in December, 2014 and even the question of charge has not been considered till date, the second respondent and the other accused being responsible for causing delay. Though the counsel for the second respondent, against whom the present petition is directed, CRL.M.C. 3888/2015

refuted that he has been guilty of any delay on instructions, he submitted that he would fully cooperate with the trial court and shall be ready to address arguments on the question of charge on the date next fixed i.e. 30.07.2018 and not seek any adjournment. He also submitted an undertaking on behalf of the second respondent that in the further proceedings, in the event of charge being framed, the second respondent would continue to fully cooperate and not cause any delay nor seek any unnecessary adjournments. The second respondent is bound by the undertakings given. The petition is disposed of in above terms.
