O R D E R

After arguments, this appeal is disposed of with the consent order, in the presence of the parties who have given instructions to their counsels, that appellant will in addition to the amount of Rs.8,00,000/- already deposited in this Court, pay a further sum of Rs.5,50,000/- to the respondent/plaintiff within a period of four months from today. Respondent will therefore receive an amount of Rs.8,00,000/- deposited in this Court along with accrued interest thereon and a further sum of Rs.5,50,000/- in four months in full and final settlement of all claims of the respective parties against each other which is subject matter of this litigation. In case the amount of RFA 944/2017

Rs.5,50,000/- is not paid by the appellant to the respondent within four months from today then on this amount of Rs.5,50,000/- interest at 12% per annum will be payable by the appellant to the respondent from today and till the date of payment and for which respondent can execute the decree against the appellant. However, on the appellant paying a sum of Rs.5,50,000/- to the respondent within a period of four months from today then no further claim will remain of the respondent against the appellant.

Registry will release the amount of Rs.8,00,000/- deposited in this Court along with accrued interest to the respondent within a period of four weeks from today.
