O R D E R

1. The original of the Memorandum of Understanding („MoU‟) dated 30th November 2013 has been produced by the counsel for the Petitioner and has also been shown to learned counsel for the Respondents.

2. Learned counsel for the Respondents states that reserving the right of the Respondents to question the validity of the before the learned sole Arbitrator, the Respondents have no objection to the disputes between the parties being referred to a sole Arbitrator.

3. Learned counsel for both the parties state that the dispute may be referred to Justice R.C. Lahoti, a former Chief justice of India, who is already adjudicating the disputes between them.

4. The Court accordingly appoints Justice R.C. Lahoti, former Chief Justice

of India as sole Arbitrator to adjudicate the disputes between the parties including their claims and counter-claims. The learned Arbitrator shall fix his own terms and communicate them to the parties.

5. The parties are directed to appear before Justice Lahoti on 15th May 2017 at 4 pm or such changed time and/or date that Justice Lahoti finds convenient which will be communicated to the parties at least ten days in advance. The venue for the first hearing will be arranged by the Petitioner and communicated to the learned Arbitrator and the Respondent at least one week prior to the date fixed. The expenses for the hearing shall be equally shared by the parties.

6. All the contentions of both the parties are left open to be urged before the learned sole Arbitrator.

7. The petition is disposed of in the above terms. A certified copy of this order be delivered to the learned Arbitrator forthwith. S.MURALIDHAR, J MARCH 22, 2017 Rm
