After some arguments learned counsel for the petitioners seeks leave to withdraw the petition because quashing of the FIR is prayed for on an alleged settlement with the complainant. There is no written settlement. 2.

Learned counsel for the petitioners states that after the petitioners enters into a written settlement with the complainant, joining the complainant as a co-petitioner and ensuring his presence in the Court on the first date of hearing the petitioners may be permitted to file a fresh petition. 3.

Granting liberty as prayed for on the condition that if it is the case of the petitioners that they have settled the dispute with the complainant, the terms of the settlement would be got reduced in writing and the complainant would be joined as a co-petitioner and his presence ensured in Court on the first date of hearing, fresh petition may be filed, instant petition is disposed of as withdrawn.
