The petitioner seeks anticipatory bail under Section 438 Cr.P.C. in case FIR No.780/2015 registered under Sections 376/377/328/313/406 IPC at PS Hauz Khas. Status report is on record. 2.

I have heard the learned counsel for the parties including the counsel for the complainant and have examined the file. The matter was referred to Delhi High Court Mediation & Conciliation Centre to explore possibility of amicable settlement. However, the matter could not be resolved there.

During the course of arguments, learned counsel for the petitioner, on instructions, stated at Bar that the petitioner was ready and willing to pay `10 lacs to the complainant without prejudice and subject to future adjustment (if any) towards dowry articles. On this, the complainant and her counsel have no objection to the grant of bail. BAIL APPLN. 1976/2015

By an order dated 18.09.2015, the petitioner was granted interim protection and was directed to join the investigation as and when required.

Undisputedly, the petitioner has joined the investigation since then. The petitioner has offered to pay `10 lacs to the complainant without prejudice towards dowry articles. It shall be paid by the petitioner through the Investigating Officer by way of demand draft within two weeks. This payment shall be without prejudice to the rights of the parties and subject to future adjustment (if any).

Considering the facts and circumstances of the case and the petitioner's offer to pay `10 lacs, he is granted anticipatory bail and in the event of arrest, he be released on furnishing personal bond in the sum of `50,000/- with one surety in the like amount to the satisfaction of the SHO/Investigating officer. He shall, however, join the investigation as and when required.

The bail application stands disposed of.
