O R D E R

% 04.07.2017 The petitioner is aggrieved by certain action/inaction on the part of the respondents. The contention of the petitioner is that he is in possession of the land in question i.e. khasra No. 607, measuring 4 bigha and 16 biswas in village Khatorna, Delhi. This fact is disputed by the petitioner.

The predecessor in interest of the petitioner had filed proceedings u/s 74 (4) of the Delhi Land Reforms Act (DLRA) in the year 1987. In the course of these proceedings, an order came to be passed on 19.03.2004 which had dismissed this petition in default as there was no appearance on behalf of the petitioner. A restoration application was filed against that order which was also decided against the petitioner vide order dated 16.06.2017. Learned counsel

for the petitioner points out that these proceedings have been challenged by way of filing an appeal before the concerned Competent Authority which is the Deputy Commissioner (DC). Those proceedings are pending.

After some arguments, learned counsel for the petitioner submits that he would really not lay a challenge to the present proceedings as he has already availed of the remedy by way of independent proceedings which are yet pending before the Revenue Authorities. Liberty is granted to the petitioner to pursue those proceedings.

Permission is accordingly granted to the petitioner to withdraw this petition.

Dismissed as withdrawn.
