% 17.02.2017 Counsel for the petitioner submits that since the respondent has raised the objection of territorial jurisdiction regarding the maintainability of the present petition before this Court and as per the respondent only High Court of Mumbai has the jurisdiction to try and entertain the present petition, the petitioner wants to withdraw the present petition with liberty to file a fresh petition under Section 482 Cr.P.C. before the High Court of Mumbai within 30 days.

Counsel for the respondent submits that he has no objection if the prayer of the petitioner is allowed.

In view of the submission made by counsel for the petitioner, the prayer is allowed and the present petition is dismissed as withdrawn with

liberty to the petitioner to file a fresh petition before the Mumbai High Court as per law within 30 days.
