% 04.02.2019 Vide proceedings dated 10.12.2018, the matter had been referred to the mediation centre. The settlement agreement dated 20.12.2018 has since been received from the Delhi High Court Mediation & Conciliation Centre. It has been submitted on behalf of either side by the learned counsel present that their vakalatnamas are on the record for either side and it has also been submitted on behalf of either side that both the parties undertake to adhere to the terms of the mediation settlement which is on the record. It is submitted on behalf of the appellant that in view of the mediation settlement, the appellant seeks to withdraw the present appeal, which is thus dismissed as withdrawn. The parties shall however, remain bound by the terms of the mediation settlement dated 10.12.2018.

In terms of Section 16 of the Court Fees Act, 1870, the court fees paid on behalf of either side in the lis be refunded to them by the Collector concerned.
