By way of this writ petition filed under Article 226 of the Constitution of India read with Section 482 Cr.P.C., petitioner is seeking quashing of FIR No. 942/2015, under Sections 323/384/452/506 IPC, registered under PS Hauz Khas.

Status report has been filed by the State.

In the status report it is mentioned that the complainant is a poor person and had been threatened by the petitioners. It is also mentioned in the status report as under:

"The victim is a poor person and running a juice shop in Gautam Nagar, ND. He is a very much threatened due to act of the accused persons. All accused have been torturing the complainant W.P.(CRL) 2096/2015

and his brother since long time for extorting the money. Accused Sanjeev Kumar Anand @ Bhondu having previous criminal involvement and the father and brother of the other accused namely Sudesh Chaudhary @ Chotra & Rajveer Singh also having criminal involvement in extortion case (Separate List Enclosed)." 4.

The complainant is present in person and states that he does not want to enter into any settlement with the petitioners who have threatened him. 5.

Keeping in view the nature and the gravity of the offence as well as facts that the settlement does not seem to have been entered into voluntarily, there is no ground to quash the FIR and the criminal proceedings arising therefrom.

The writ petition stands dismissed.
