% 14.03.2016 I.A. No. 3386/2016 This application has jointly been moved by the parties under Order XXIII Rule 3 CPC to record their settlement.

The parties are also present with their respective counsel. The application has been signed by the parties and their respective counsel. The application is also supported by the affidavit of Mr. Ashish Arora (plaintiff), Mr. Manish Arora (defendant No.1), Ms. Kanchan Arora (defendant No.2) and Mr. Praveen Kumar Arora (defendant No.3). The memorandum of settlement arrived at between the parties on 01.03.2016, on which the present application is premised, has been placed on record. The parties have also placed on record a Will of Mr. Ramesh Chander, S/o Late Sh. Kartar

Mal dated 25.03.2009, on record. The terms of settlement appear to be fair, just and reasonable and there is no impediment in accepting the same. Accordingly, the suit is decreed in terms of the memorandum of settlement (Annexure-X) filed along with the application. The parties shall remain bound by the same. The memorandum of settlement will form part of the decree.
