% 26.09.2017 This suit for declaration, possession and injunction was filed in this Court on 18th September, 2015. Registry raised certain objections on 19th September, 2015. Till date objections have not been removed. Suit has been listed on office note. In terms of Rule-5(1) and 5 (2), Part-A (a), Chapter-I, Volume-5 of Delhi High Court Rules and practice directions objections were required to be removed within 30 days. As the plaintiff has failed to remove the objections within 30 days prescribed, the suit is liable to be dismissed for non-prosecution. At this stage, learned counsel for the plaintiff appears. On instructions from the plaintiff, who is present in Court learned counsel for the plaintiff seeks leave to withdraw the suit. Consequently, the suit is dismissed as withdrawn. MUKTA GUPTA, J.
