% 27.07.2017 It has been informed at bar that the investigation with respect to the FIR No.152/2013 dated 07.06.2013 (PS EOW) instituted for the offences under sections 406/409/420/120B of the IPC has been completed so far as the petitioner is concerned and a report under section 173 of the Cr.P.C. has been submitted.

In that view of the matter, learned counsel for the petitioner does not press this application any further as it has become infructuous. It does not require to be stated that once the summons are issued against the petitioner and the petitioner appears pursuant to the summons,

the Trial Court shall take into account the fact that the petitioner had participated in the investigation and had not misused the privilege granted to him.

Disposed of as not pressed.
