% 22.04.2016 The present petition is for initiating contempt proceedings against the respondent for his wilful default in complying with the order dated 20.07.2015 passed in W.P.(C) No.6160/2015.
The petitioner had been allotted a plot by DDA in a draw at maturity of the priority number.
Considering the aforesaid allotment, the consideration amount as directed by DDA was paid by the petitioner. However, the allotment of the plot was cancelled on the pretext of some documents not having been furnished in time.
The petitioner thereafter preferred writ petition seeking revalidation of the allotment. The respondents were directed to hold a draw and allot the plot to the petitioner. Even though the plots were allotted to other persons but no plot was allotted to the petitioner even though he was one of the first registrants for allotment
of plot in his favour. A direction was therefore given to the respondent to conduct a draw preferably within a period of four weeks and thereafter allot a plot to the petitioner. The present contempt petition was preferred as the draw had not been conducted despite the categorical orders of this court. Today, the counsel for the respondent informs that the draw has been conducted and a plot bearing No. 49, Pocket-11, MIG Category has been allotted to the petitioner.
The proceedings therefore are dropped.
However, the respondent is directed to expeditiously handover the demand cum allotment letter to the petitioner preferably within a period of six weeks from today.
The petition stands disposed of.
