After arguments, this appeal is disposed of by a consent order by setting aside the impugned judgment dated 7.9.2017 decreeing the suit under Order 12 Rule 6 CPC, with the consequent directions that the suit will be disposed of at the stage of final arguments after evidence is led by the parties, in accordance with law. However, it is made clear that in view of the fact that the suit is pending since 14.7.2011, none of the parties will be allowed to take unnecessary adjournments by the trial court, and if unnecessary adjournments are sought, trial court is entitled to impose heavy costs on the parties seeking unnecessary adjournments.
