% 27.02.2019 Petitioner by this petition was seeking a direction to the SHO/Investigating Officer, P.S.Farsh Bazar to submit charge sheet in FIR No.698/2014 under Section 451/323/506/356/379/34 IPC. Learned APP under instructions submits that chargesheet has already been filed and matter is pending before the Trial Court for arguments on charge.

Learned counsel for the petitioner submits that chargesheet has been filed by amending the sections and the facts substantially show that offence under Section 392 Indian Penal Code, 1860 is made out. She seeks leave to withdraw the petition reserving her right to raise the said issue before the Trial Court at the time of arguments on charge. Petition is accordingly dismissed as withdrawn with the liberty to the petitioner as prayed for.
