IN THE HIGH COURT OF DELHI AT NEW DELHI

+ CRL.M.C. 4546/2017 MOHD RIZWAN ..... Petitioner Through:

Mr. Mayank Tripathi and Mr. Vijay Shukla, Advs. along with petitioner in person.

versus STATE OF NCT OF DELHI & ANR ..... Respondents Through:

Mr. M.S. Oberoi, APP for State with SI Sunil Kumar, P.S. Govind Puri.

Respondent no.2 in person.

CORAM:

HON'BLE MR. JUSTICE A.K. PATHAK

O R D E R

% 28.02.2018 Respondent no. 2 Ms. Noorfeesha is present in Court and has been identified by SI Sunil Kumar of police station Govind Puri. She submits that she has settled the matter with the petitioner of her own free will and without any undue force, pressure or coercion vide Memorandum of Understanding dated 3rd February, 2015. She further submits that she has already received entire settled amount of `4 lacs from the petitioner and has no objection in case FIR is quashed.

Keeping in mind the settlement arrived at between the petitioner and respondent no.2 voluntarily, in my view, no fruitful purpose would be served in keeping the criminal proceedings pending. Accordingly, in the interest of justice, FIR No. 463/2011 under Sections 498A/406/34 IPC

registered at police station Govind Puri and the consequent proceedings emanating therefrom are quashed.

Petition is disposed of in the above terms.

Dasti.
