% 26.11.2018 I.A. 15972/2018 Present application has been filed under Order 23 Rule 1 read with Section 151 CPC seeking withdrawal of the present suit. It is pertinent to mention that present suit had been filed by the predecessor in interest of the plaintiff for infringement of registered designs and damages as well as permanent and mandatory injunction. In the present application for withdrawal it is averred that the registered design nos. 226704 and 229555 on the basis of which the present suit had been filed, have been cancelled by the Controller of Patents and Designs.

Keeping in view the aforesaid fact, the present suit is dismissed as withdrawn and all pending applications stand disposed of. All interim orders stand vacated. The next date of hearing is cancelled. MANMOHAN, J NOVEMBER 26, 2018/rn
