O R D E R

% 27.10.2017 The petitioner's grievance is that it was not allowed to participate in the e-auction for parking sites notified in the advertisement issued by the North Delhi Municipal Corporation (NDMC). The petitioners state that 32 out of 38 bids suffered the same fate and that they were not allowed to participate in the eauction. The tender/NIT invited bids for regular allotment of 60 authorised parking sites within the jurisdiction of the NDMC. It is contended by counsel for the respondent, appearing on advance notice, that the NIT dated 24.08.2017 and the e-auction conducted thereafter have since been cancelled by the order of the Commissioner.

The Court is of the opinion that the reasons which persuaded the NDMC to block the e-auction of the petitioners and others (all the 32 out of 38) who had sought to participate in the auction, should be communicated.

The NDMC shall ensure that these reasons shall be communicated to the parties concerned individually, if requested. However, this process should be completed within a short time frame; and in case of the petitioners, the reasons shall be communicated within a week.

The fresh NIT shall thereafter be issued and proceeded. In view of the above, the writ petition is disposed off. Order Dasti to the parties.
