O R D E R

% 17.01.2018 Vide the present petition, the petitioner seeks quashing of the FIR No. 188/15, registered at PS IGI Airport, under Section 25, 54 & 59 of the Arms Act, 1959 as well as the summoning order dated 28.03.2017 and all proceedings emanating therefrom which are pending in CC No. 883/2017 before the learned Court of ACMM, Patiala House Courts, New Delhi submitting to the effect that the charge-sheet has been submitted under Section 25 of the Arms Act, 1959 and no offence is made out in the facts and circumstances of the case in as much as there was no possession of any arm.

At this stage, however, learned counsel for the petitioner seeks to withdraw the present petition with a prayer seeking permission to submit all contentions made in the present petition before the learned Trial Court at the time of the consideration of the charge.

In view of the said submission, the petition is dismissed as withdrawn with liberty granted as prayed.
