O R D E R

% 16.11.2017 Notice could not be issued to the respondent no.2 as process fee was not filed. However, respondent no.2 is present in Court and accepts notice. He has been identified by SI Anil Rathor of police station Neb Sarai. Respondent no.2 submits that he has settled the matter with the petitioner vide Memorandum of Understanding dated 18th January, 2017 of his own free will and without any undue force, pressure or coercion. As per the FIR, respondent no.2 had given his car to the petitioner for one day but the same was not returned by the petitioner. Respondent no.2 submits that his car has now been returned by the petitioner, therefore, he is not willing to pursue the FIR any further and the same may be quashed. Keeping in mind that a settlement has been arrived at between the

petitioner and respondent no.2 and respondent no.2 has no objection in quashing of the FIR, in the interest of justice, FIR No. 808/2016 under Section 406 IPC registered at police station Neb Sarai and the consequent proceedings emanating therefrom are quashed.

Petition is disposed of in the above terms.
