The counsel for the plaintiffs states that as per the website of the Ministry of Corporate Affairs, the name of defendant no.3 Estar Web Productions Pvt. Ltd. has been struck off; the defendants no.1 and 2 Mr. Yogendra and Mr. Naveen Danta were sued as Directors of the defendant no.3 and the defendant no.4 iNeel Technologies was functioning from the premises of the defendant no.3. It is further stated that the plaintiff has also been unable to serve the defendants till now and thus was desirous of withdrawing the present suit and the counsel for the plaintiffs had forwarded an application to the plaintiffs for withdrawal of the suit but which, after signing, has been received from the plaintiffs yesterday only and thus could not be filed.

The counsel for the plaintiffs is permitted to handover the application in the Court and the same is taken on record and be got numbered. 3.

IA No.6450/2018 is allowed and disposed of.

CS(COMM) No.728/2017 4.

The suit is dismissed as withdrawn, leaving the parties to bear their own costs.
