% 30.11.2018 The petitioner's application for anticipatory bail was rejected on 02.07.2016. He fully well knew about the investigations being carried out in case bearing FIR No.0574/2015, registered under sections 307/34 of the Indian Penal Code, 1860 and section 25 of the Arms Act, 1959, at Police Station Gokulpuri, Delhi, in which he apprehends coercive measures. He now seeks anticipatory bail after a lapse of more than 28 months. The relief sought is opposed by Mr. Katyal, the learned Additional Public Prosecutor for the State. He submits that diligence and bona fides of the petitioner would have been manifest if he had approached this Court earlier; he now comes to the Court when proceedings under section 82 Cr.P.C. have been initiated against him; he has been evading arrest and even his co-accused have not been giving his address. In the circumstances, the petition may be dismissed.

At this Stage, the learned counsel for the petitioner seeks to withdraw the petition.

Accordingly, the petition stands dismissed as withdrawn. NAJMI WAZIRI, J.
