CORAM:
HON'BLE MR. JUSTICE SANJEEV SACHDEVA
O R D E R
% 11.01.2018 Crl.M.A.No. 17604/2017 (Exemption) Exemption allowed, subject to just exceptions. Application stands disposed of.
Crl.M.C.No. 4390/2017 1.
The petitioner seeks quashing of FIR No. 461/2015, P.S. North Rohini under Sections 308/506 IPC. The petitioner and respondents are neighbours. Though FIR is under Section 308 IPC as per medical opinion the injury sustained by the complainant was simple in nature. 2.
The petitioner and respondents who are young students and beginning their life and career with the intervention of elders and respectable members of the respective families have resolved the disputes. The respondents No.2 & 3 are present in Court and confirm CRL.M.C. 4390/2017
that the dispute between the parties have been resolved. compromise deed dated 20th October, 2017 has been executed between the parties. They confirm that they do not wish any charges against the petitioner. Respondent No.2 & 3 are present in Court and are identified by the Investigating Officer.
3.
Keeping in view the facts that the parties have settled the disputes and that the petitioner and the complainant are young boys of the same locality and the dispute occurred over a minor issue. In my view, no fruitful purpose would be served in continuing with the criminal prosecution. It would be expedient and in the interest of justice to quash the FIR and the consequent proceedings arising therefrom.
4.
In view of the above, the petition is allowed and FIR No.461/2015 and the consequent proceedings arising therefrom are quashed.
5.
