O R D E R

The learned counsel for the petitioner states that a settlement has been arrived at between the petitioner and her husband. In terms of the settlement her husband (Shri Deepak Arora) has agreed to pay a sum of ₹55 lacs (in three instalments) to the petitioner in full and final settlement of all her claims. The petitioner has also agreed to vacate the premises in question on the final instalment of ₹12 lacs being made. The petitioner also states that the said agreement has been witnessed by respondent no.2. A copy of the said settlement has been handed over by the learned counsel for the petitioner. The same is taken on record.

In view of the above, the direction to raise a brick wall and open an access as directed by the Maintenance Tribunal in the impugned order dated 24.10.2017, need not be implemented. The petitioner is also not required to pay the electricity and water charges and obtain a connection in her name.

The said directions are set aside.

No further interference in the impugned order is called for. The petition and pending application are disposed of. VIBHU BAKHRU, J NOVEMBER 14, 2017 MK
