Notice to show cause as to why rule nisi be not issued. 2.

Mr. Vasundhara Nayyar, Advocate who appears for Ms. Mini Pushkarna, learned Standing Counsel for the North Municipal Corporation of Delhi accepts notice for both the respondents. 3.

This writ petition assails the order dated 26th September, 2017 issued by the Addl. Commissioner (DEMS), North Delhi Municipal Corporation whereby the respondent No.2 has notified various authorities in the North Delhi Municipal Corporation to allocate 26000 Safai Karamcharis working in six zones of North Pg.1 of 3

Delhi Municipal Corporation to the different wards. This order informs all the Deputy Commissioner to take congnizance of this figure which are being provided to us in another PIL and distribute 250 Safai Karamcharis given per ward to be equally distributed and rationalised depending upon the area of a particular ward. 4.

Learned counsel for the petitioner submits that the same includes the fact that the size as well as population in the ward may vary and different wards may have varying needs as far as allocation of Safai Karamcharis is concerned to enable them to perform municipal and sanitation functions.

We take note of the last paragraph of the order dated 26th September, which also mandates that the Deputy Commissioners shall also rationalize the distribution of the Safai Karamcharis depending upon the area of a particular ward. The said order mandates the distribution and rationalization to be effected within two days in consultation with Municipal Councillors, Chief Engineers, SEs and other concerned officers of the respective zones.

It would appear that the North Delhi Municipal Corporation is conscious of the fact that different wards have varying needs of allocation of Safai Karamcharis and the authorities have been mandated to undertake the exercise of evolution of such needs and to accordingly distribute available work force. 7.

In view thereof, the respondents shall ensure that the directions with regard to the rationalization and distribution of the Pg.2 of 3

Safai Karamcharis amongst the different wards of the North Delhi Municipal Corporation is undertaken at the earliest and uploaded on the website of the respondents.

Such exercise should be completed within a period of two weeks from today. 8.

Liberty is granted to the petitioner to approach this Court in case any difficulty arises.

The writ petition is disposed of in the above terms. Dasti to the parties.
