This Rent Control Revision Petition under Section 25B(8) of the Delhi Rent Control Act, 1958 impugns the order [dated 13th April, 2017 in E No.133/2016 (New No.80961/2016) of the Court of Additional Rent Controller (ARC) (Central), Tis Hazari Courts, Delhi] of eviction of the petitioner from ground floor of house No.10923, Laxmi Niwas, Doriwalan, Manakpura, Karol Bagh, New Delhi-05 as a consequence of the non-filing by the petitioner of the application for leave to defend the petition for eviction.

After full arguments, the counsel for the petitioner, under instructions from the petitioner and her daughter present in Court, states that the petitioner does not press this petition for eviction and withdraws the same and will abide by the order of eviction and confines the relief only to grant of time of three years to vacate the premises. Issue notice, limited to the aforesaid aspect, to the respondent by all modes including dasti and through the counsel for the respondent before the Trial Court returnable on 6th November, 2017. 4.

The learned Administrative Civil Judge before whom the warrants of possession, stated to have already been issued are placed on 6th November, 2017 at 1000 hours, is requested to allocate the bailiff for a date after one week from 6th November, 2017.

A copy of this order be given dasti under the signatures of the Court Master.
