CORAM:

HON'BLE MR. JUSTICE RAJIV SAHAI ENDLAW

O R D E R

% 01.11.2017 CM No.39002/2017 (for exemption) 1.

Allowed, subject to just exceptions.

2.

The application is disposed of.

RC.REV. 491/2017 & CM No.39001/2017 (for stay) 3.

This Rent Control Revision Petition under Section 25B(8) of the Delhi Rent Control Act, 1958 impugns the order [dated 15th July, 2017 in RC/ARC No.760/2016 of the Court of Rent Controller (East), Karkardooma Courts, Delhi] allowing the application of the respondent for leave to defend the petition for eviction under Section 14(1)(e) of the Act filed by the petitioners.

4.

I have perused the petition for eviction, the application for leave to defend along with the affidavit filed by the respondent and the reply of the petitioners thereto and do not find merit in the challenge made to the order. On a reading of the aforesaid pleadings, the learned ADJ has correctly found a case for grant of leave to defend to have been made out. RC.REV. 491/2017

5.

I am refraining from giving any further reasoning lest it affects the final adjudication of the petition for eviction. 6.

Dismissed.

No costs.
