By this petition the petitioner seeks anticipatory bail in case FIR No. 342/2017 under Sections 308/34 IPC registered at PS Mansarovar Park, Delhi on the complaint of one Rinku Gupta.

The allegations of the complainant in the FIR in question are that on 28th September, 2017 at about 10.30 PM while he was coming back to his residence after fetching articles from the market, on the road, he met Teetu Ahuja. Teetu Ahuja started abusing him and stated that these days the complainant was not behaving properly and he would set him right. While abusing the complainant Teetu Ahuja in anger picked up a wooden plank and hit him on his head. In the meantime, the petitioner herein, that is, Aman Ahuja, son of Teetu Ahuja came and he with a wooden bat also hit Rinku Gupta on the head. Thereafter both Teetu Ahuja and Aman Ahuja BAIL APPLN. 2177/2017

left the place.

As per the MLC, injury on Rinku Gupta is a lacerated wound of 5x2 cms. on the parietal region. Thus there is only one injury as per the MLC. Teetu Ahuja the main assailant has since been arrested and granted bail. Considering the role assigned to the petitioner and that as per the MLC only one injury was caused on the head/body of the injured, this Court deems it fit to grant anticipatory bail to the petitioner. 4.

It is, therefore, directed that in the event of arrest the petitioner be released on bail on his furnishing a personal bond in the sum of ₹25,000/- with one surety of the like amount, subject to the satisfaction of the Arresting Officer/SHO concerned, further subject to the condition that the petitioner will join the investigation as and when directed by the Investigating Officer and in case of change of residential address, the same will be intimated to the Court concerned by way of an affidavit. 5.

Petition is disposed of.
