% 24.11.2017 The petition at hand takes exception to the directions in the order dated 06.09.2017 issued by the court of additional district judge on the file of civil suit 77721/2016 (old no.123/16) whereby the civil suit has been made over to the Commercial Division of this Court. The learned counsel on being asked submits that pursuant to the directions in the impugned order, the matter has already come up before a learned single judge of this Court on the original side on 12.11.2017 and is notified for 19.01.2018.

The appropriate course in the facts and circumstances would be for the petitioner to raise all the contentions urged by the petitioner at hand before the learned single Judge in seisin of the matter on the original side for appropriate relief by appropriate application. The petition alongwith the applications filed therewith are disposed of with these directions.
