+RFA No.912/2017 and C.M. Nos.39295/2017 (stay) & 39296/2017 (exemption) 2.

After arguments, this appeal is disposed of as not pressed as the appellant states that appellant will vacate the suit premises on or before 30.4.2018. It is also stated that appellant will continue to pay any charges for use of electricity, water etc till the time the appellant continues to stay in

the suit premises.

Counsels for the parties also agree that rate of mesne profits granted by the trial court will stand reduced to Rs.10,000/- per month and interest payable on arrears will also stand reduced from 9% per annum to 6% per annum subject to the condition that the arrears of the mesne profits at Rs.10,000/- per month in terms of the impugned judgment are cleared by the appellant on or before 31.12.2017. 3.

Let the appellant file an affidavit of undertaking in this Court in terms of the present order within two weeks and on the appellant filing the undertaking and complying with the terms of the same, appellant will have time to vacate the suit premises on or before 30.4.2018. 4.
