% 19.12.2017 Learned counsel for the petitioner submits that petitioner was lodged in Tihar Jail at the time of alleged offence. As per the prosecution, petitioner was in touch with the co-accused Vinod @ Sillu and Harvinder @ Monu and Amarjeet @ Kunal on the mobile phone. They were planning to kill Sanjit @ Bunty and Mintu @ Kaka. This fact was disclosed from the intercepted mobile conversation.

Learned counsel further submits that Investigating Officer failed to search alleged Sanjit @ Bunty and Mintu @ Kaka. No dead body was recovered. No material could be found during the investigation to indicate that any person was even killed pursuant to the alleged conspiracy. No

weapon was recovered from the petitioner.

Even mobile phone was not recovered from the petitioner.

Keeping in mind the totality of the facts and circumstances of this case, petitioner is admitted to bail, subject to his furnishing a personal bond in the sum of `10,000/- (Rupees Ten Thousand Only) with one surety in the like amount to the satisfaction of the trial court.
