% 05.02.2018 Crl.M.A.21370/2017 (for condonation of delay in re-filing) For the reasons stated in the application, the application is allowed. The delay in re-filing of the petition is condoned. CRL.M.C. 5496/2017 1.

The petitioners, by the present petition, seek quashing of FIR No.268/2013 under Sections 323/341/427/452/34 IPC, Police Station Patel Nagar based on a settlement.

It is informed that the respondent No.2 has expired on 12.01.2018. The respondent No.3 is the wife of the respondent No.2 and the respondent No.4 is the son of the respondent No.2.

Parties are neighbours and with the intervention of the members of the locality and other senior members of the respective families, parties CRL.M.C. 5496/2017

have settled their disputes and executed compromise deed dated 14.09.2017.

The respondents are present in person and are identified by the Investigating Officer.

They confirm that the parties have settled their disputes and they do not wish to prosecute the criminal proceedings any further.

In view of the above and keeping in view of the fact that the parties have resolved their disputes and respondents do not wish to press their complaint, and continuation of criminal proceedings will be an exercise in futility and justice in the case demands that the dispute between the parties is put to an end and peace is restored; securing the ends of justice being the ultimate guiding factor. It would be expedient to quash the subject FIR and the consequent proceedings emanating there from. 6.

In view of the above, the FIR No.268/2013 under Sections 323/341/427/452/34 IPC, Police Station Patel Nagar and the consequent proceedings emanating there from are quashed. 7.
