O R D E R

% 09.01.2020 During the course of hearing, it transpires that the respondent bank - Punjab National Bank has not taken into account the ratio of the judgment in LPA 507/2010 Punjab National Bank v. Rajinder Kumar and Mr. Bhalla, ld. counsel for the petitioner on instructions submits that the petitioner would be satisfied if in the first instance, the instant petition and the rejoinder filed by the petitioner is treated as the representation and a speaking order is passed thereon as regards his claim(s) for promotion(s). Mr. Gautam, ld. counsel for the respondent bank is not averse thereto.

Taking into account the totality of facts and circumstances, the writ petition is disposed of with the direction to the respondent bank - Punjab National Bank to treat the instant petition as also the rejoinder filed as a representation of the petitioner and having afforded an opportunity of hearing to the petitioner, if he so desires, dispose of the same at the earliest, preferably, within 12 weeks from today.

Should the petitioner feel

aggrieved of the decision so taken, he would be at liberty to assail it in accordance with law. It is clarified that any of the pleas of the parties raised in the instant petition are kept open to be agitated in the event, the petitioner approaches the Court afresh.
