After arguments, this appeal is disposed of with the following consent order:- (i) The impugned judgment of the trial court dated 27.8.2016 is set aside but without expression in any manner on the merits of the case of the respective parties.
(ii) The suit will now be decided after evidence is led by all the parties, and at the stage of final arguments in accordance with law after trial and completion of pleadings.
(iii) Four appellants, who are the four defendants in the suit, with appellant no. 4/defendant no.4 having been expired, before they are
represented by their attorney(s), will personally appear in the trial court and give a statement that they are being represented by which attorney(s) and through which power of attorney(s). This will be done when the written statement is filed before the trial court by the appellants/defendants.
(iv) Both the parties will not get more than four opportunities each to complete their evidence-in-chief, failing which the right to lead evidence will stand closed.

Parties to appear before the District and Sessions Judge, South District, Saket Courts, New Delhi on 30th January, 2019, and the District and Sessions Judge will now mark the suit for disposal to a competent court in accordance with law and the observations made in the present order.
