BAIL APPLN. 2207/2017 1.

The petitioner has filed the instant application under Section 439 Cr.P.C. seeking regular bail in case FIR No.151/2017 under Sections 354/323/508/509 IPC and Section 12 of POCSO Act, PS Delhi Cantt. 2.

Notice. Learned APP for the State accepts notice and furnishes the status report.

Earlier the petitioner has filed Bail Application No.1449/2017 wherein interim protection was granted on 28th July, 2017 till the next date of hearing i.e. 21st August, 2017. However, on 21st August, 2017 when the BAIL APPLN. 2207/2017

counsel for the petitioner as well the petitioner failed to appear, the application seeking anticipatory bail was dismissed for non-prosecution. 4.

As per the status report after the dismissal of the application seeking anticipatory bail, the petitioner was arrested on the same day i.e. on 21st August, 2017 and since then he is in judicial custody. Charge-sheet has also been filed.

Since the petitioner has already joined the investigation during the period he was granted protection and thereafter, after dismissal of his bail application, he was arrested and charge-sheet has been filed, I find it to be a fit case to enlarge the petitioner on bail.

Accordingly, the petitioner is admitted to bail on his furnishing personal bond in the sum of `50,000/- with one surety in the like amount to the satisfaction of learned Trial Court/Link Court subject to the condition that he shall not contact the complainant or public witnesses in any manner whatsoever.

The bail application is allowed.

As prayed, copy of the order be given dasti to learned counsel for the petitioner.
