By this petition, the petitioner seeks anticipatory bail in case FIR No.431/2017 under Sections 308/34 IPC registered at PS Mianwali Nagar on the complaint of Manoj, S/o Vijay. Notice was issued in the petition on 31st October, 2017 when this Court directed that in the meantime i.e. till the next date of hearing, no coercive steps be taken against the petitioner subject to his participating in the investigation as and when required. 2.

Learned APP for the State submits that on the perusal of the police file it appears that the then Investigating Officer of the abovenoted FIR accepted the bail bond and surety bond from the petitioner, released him thereafter and filed the charge sheet.

Learned counsel for the petitioner submits that the petitioner has not been summoned by the learned Trial Court as yet, thus he is not aware if the BAIL APPLN. 2179/2017

charge sheet has been filed.

The allegations in the above noted FIR are of catching hold and beating by wooden danda on the body and head, besides it is also alleged that he complainant had ₹39,000/- and a phone in his pocket which either fell down or had been taken out. Considering the nature of allegations and the fact that the petitioner has already been released on bail and charge sheet has been filed, no further orders are required to be passed in this petition. 5.

Bail Application is disposed of.
