O R D E R

% 05.12.2017 During the course of hearing, matter has been settled between the petitioner and respondent no.2. The total amount of the three cheques involved in this case is `2.42 lacs. Petitioner has offered to pay `3 lacs to the respondent no.2 towards full and final settlement of the amounts of the three cheques involved in this case.

Respondent no.2, who is present in Court along with his counsel, submits that this offer is acceptable to him. He has no objection in case offence under Section 138 of the Negotiable Instruments Act, 1881 is permitted to be compounded, subject to release of `3 lacs by this Court.

Accordingly, offence under Section 138 of the NI Act is permitted to

be compounded and petitioner is acquitted. Let the amount lying deposited in this Court along with interest accrued thereon, if any, be released by the Registry to the respondent no.2 forthwith. Learned counsel for the petitioner submits that `1.21 lacs was deposited by the petitioner with the trial court at the time of grant of bail. Let `1.21 lacs along with interest accrued thereon, if any, be released by the trial court to the petitioner. Petition is disposed of in the above terms.
