% 09.08.2018 Vide order dated 05.12.2017 it had been observed to the effect that the petitioner inter alia had submitted that the impugned order of eviction was not challenged on merits and instead only enlargement of time for vacation of the premises was sought and the respondent had thus submitted that he was ready to grant time to the petitioner to vacate the premises on or before 30.09.2018 subject to appropriate conditions being imposed including as to payment of market rent and both sides were granted liberty to come with documents in support of their respective contentions as to the appropriate market rent with the proceedings having been re-notified for the date 09.02.2018 and then to the present date i.e. 09.08.2018.

Learned counsel for the respondent however submits that vide proceedings dated 06.06.2018 in case no. Execution no.37/18 in CIS No.602/18 the vacant peaceful possession of the tenanted premises has already been received. Apparently, the petition has become

infructuous and there is also none present on behalf of the petitioner, the petition is thus dismissed for non-prosecution. ANU MALHOTRA, J AUGUST 09, 2018 vm
