Counsel for petitioner Mr. G.B. Singh appears and prays that they have already undergone about 3 years of custody which is evident from the Nominal Roll which is on record.

He seeks the indulgence of this Court that sentence be reduced to the period already undergone. He has no objection that the conviction is sustained.

This Court has perused the judgment of conviction and order on sentence. The case was registered upon the complaint of the PS EOW on the basis that between August, 2015 to June, 2016, the petitioner cheated dishonestly induced unemployed youth by impersonating a CBI officer and to arrange a job for them and deceived them to the tune of Rs. 2.27 lacs in total. 4.

and sentence was passed by order dated 17th November, 2017, awarding him sentence for 5 years along with fine of Rs. 20,000/-. 5.

Counsel for petitioner states that the fine has been paid. The said order was appealed against in the Sessions Court in CRL. Appeal No. 503/2017 which was dismissed by order dated 19th November, 2018. 6.

Considering the facts and circumstances, and the petitioner has already undergone 3 years of custody, the Court has considered it fit to allow the appeal of the petitioner. Nothing adverse was pointed out by counsel for CBI. 7.

Accordingly, the sentence as passed, is, accordingly, reduced to the period already undergone.

The judgement of conviction is, however, confirmed. 9.

Petition is disposed of in the above terms.
