% 09.11.2017 This petition seeks quashing of FIR No. 012/2010 dated 15.01.2010 under Sections 498A/406/34 IPC, P.S. Sultan Puri, District Outer Delhi, Delhi. The parties were married to each other. They are now living separately. They have subsequently entered into a compromise deed cum talaknama dated 18.08.2017. As per compromise, the petitioner has to pay a sum of Rs.1,35,000/- in three instalments. Final payment of Rs.45,000/- has been paid in the Court today. This amount is towards full and final settlement of all claims of the respondent including past, present and future maintenance, permanent alimony, stridhan, dowry and jewellery articles, deferred
mehar and maintenance for the iddat period etc. The parties are present in the Court today and they have been identified by their respective counsel. They reiterate the terms of the settlement and undertake to abide by it. The petition is supported by the affidavits of the parties. Since the complainant/respondent herself is not interested in pursuing the case any further, no useful purpose would be served by keeping alive the proceedings arising out of the aforesaid FIR as the same would be an exercise in futility. In the circumstances, FIR No. 012/2010 dated 15.01.2010 under Sections 498A/406/34 IPC, P.S. Sultan Puri, District Outer Delhi, Delhi and all other proceedings emanating therefrom are hereby quashed.
The petition is disposed off in the above terms. NAJMI WAZIRI, J NOVEMBER 09, 2017/acm
