O R D E R

% 02.11.2017 Learned counsel for the petitioner submits that the allegations against the petitioner are that he was in touch with the main accused on phone, inasmuch as had received the stolen property. Learned counsel further submits that the offence alleged against the petitioner, at best, would be under Section 412 IPC. Learned APP submits that petitioner had conspired with the main accused. He had also received robbed property. One gold chain, one gold ring and two diamond rings were recovered from the petitioner. However, it has not been disputed that petitioner was not one amongst the accused, who had actually committed the dacoity.

Petitioner is in custody for about four months. Investigation is complete. Charge-sheet has been filed.

Keeping in mind the totality of the facts and circumstances of this case, petitioner is admitted to bail, subject to his furnishing a personal bond in the sum of `10,000/- (Rupees Ten Thousand Only) with one surety in the like amount to the satisfaction of the trial court. Bail application is disposed of in the above terms. Miscellaneous application is disposed of as infructuous. Dasti. A.K. PATHAK, J.
