HON'BLE MR. JUSTICE A. K. CHAWLA

O R D E R

% 13.11.2017 Petitioner has approached this Court seeking issuance of Writ of Mandamus with the relief, as under :

"A direction, order or writ in the nature of mandamus or any other appropriate writ thereby directing the respondent No.1 to restore the electricity connection through its CA No. 60016826442 which was disconnected on the behest on respondents no. 2 & 3 or in alternative the respondent no.1 may kindly be directed to release the connection no. through CA No. 60017512819 at premises no. IInd floor, C-161, Prashant Vihar, Delhi-110085 for the load of 11 KW for lift for domestic purpose and respondent no.4 may kindly be directed to ensure that the respondent no. 2 & 3 will not create any problem for fixing of the meter ...." During the course of hearing, ld. Counsel for the petitioner concedes that there is an independent connection for the floor owned and occupied by the petitioner and that, the dispute pertinently is in

relation to the operation of the lift installed in the building. Can an independent electricity connection be provided to one of the floor owners/occupiers?

Subject would require technical consideration. None of the counsel for the parties is able to advert to it. In the given circumstances, the writ petition is disposed off with the directions that the petitioner may approach the respondent by making an appropriate application in that regard, which shall be duly considered by TPDDL as per norms and the feasibility, by a speaking order.
