The present case has been listed before this Court in view of the Order dated 09.12.2025 passed by the Ld. Joint Registrar. The Order dated 09.12.2025 reads as under:
"Test.Cas. 65/2017
1. Matter is at the stage of Petitioner's Evidence.
2. Learned counsel for the petitioner submits that a suit for partition bearing CSDJ/206311/2016 titled Indu Jain v. Anjali Aggarwal and Ors. qua the suit property is pending before the District Court and the main contesting parties in the present petition have agreed for partition of the suit property with share of 1/3rd each. However, the respondent no. 3&4 insist that prior to the partition of the suit property, the present petition be withdrawn by the petitioner and as per instructions, the petitioner is willing to withdraw the present petition subject to the partition of the suit The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. Learned Counsel appearing for the Petitioner, on instructions, seeks permission to withdraw the present petition i.e., TEST.CAS. 65/2017. 3.
Mr. Naveen Goel, Plaintiff, who has joined the proceedings through video conferencing, states that he has instructed the Counsel has instructions that the present petition may be withdawn. Mr. Naveen Goel, Plaintiff, has been identified by the learned Counsel for the Plaintiff. 4.
In view of the above, the present petition is disposed of as withdrawn, along with pending application(s), if any.
