% 14.03.2018 Ms. Deepakshi Jain, the proxy counsel for the appellant states upon instructions from the appellant, who is present in person and whom she identifies, that she is under instructions to withdraw the appeal. A proof of the appellant's identity by way of a DTC Pass, duly signed by him and his counsel, has been taken on record.

In the circumstances, the appeal, alongwith pending application, is dismissed as withdrawn. However, an affidavit to this effect specifying the current telephone number of the appellant and such addresses including electronic mail and other addresses at which the appellant could be contacted or notice could be served upon him, be filed by tomorrow, with an advance copy of the same to learned counsel for the respondent. The learned counsel shall ensure that the telephone number given by the appellant, is

functional.
