% 13.12.2017 Prayer made in the petition has been perused. Learned counsel for the petitioner submits that provisions of Rule 138 of the Delhi Education Rules, 1973 have been violated. Even presuming that the petitioner has suffered a compartment he is still entitled for readmission in the same class; he cannot be ousted. On advance notice, learned counsel for respondent has put in appearance.

Learned counsel for the respondent under instructions submits that this writ petition may be treated as representation qua the petitioner and the same shall be answered in accordance with law by the Competent Authority. Petitioner agrees to this proposal. Ordered accordingly; the present petition be accordingly treated as

representation qua the petitioner.

The Competent Authority/respondent nos.1 and 2 shall answer this representation within an outer limit of four weeks from today after giving a hearing to the petitioner and notifying him of the outcome of the representation.

Petition disposed of in the above terms.
