By this petition, the petitioner seeks anticipatory bail in case FIR No. 223/2017 under Section 420 IPC registered at Police Station Karol Bagh on the complaint of one Sh. Amit Gupta under Section156 (3) Cr.P.C. 2.

The allegations of the complainant in the above noted FIR was that the complainant and the petitioner were in the business of gems and jewellery. Thus, the petitioner, who was having his show room at Shop No. 103,2058, Gold Plaza Building, Gurudwara Road, Karol Bagh used to buy jewellery from the complainant and has an outstanding amount of ₹53,33,028/- towards the complainant. In discharge of his partial liability, the petitioner issued two cheques for a sum of ₹11,00,000/- and ₹19,00,000/- respectively drawn on Bank of India. the petitioner issued instruction to stop payment for the value of ₹19,00,000/- and with respect to other cheque of ₹11,00,000/-, the bank account was found to be closed.

Complaint under Section 138 Negotiable Instruments Act has already been filed and the petitioner has already joined the investigation in present FIR. Further the petitioner gave his permanent address where he was found residing in a premises owned by his wife at House No. 1765/6, Ist Floor, Govind Puri Extension, Kalkaji, New Delhi, which fact has been verified. 4.

Since, the petitioner has roots in the society, and has joined the investigation, this Court deems it fit to grant anticipatory bail to the petitioner. In the event of his arrest, the petitioner be released on bail on his furnishing personal bond in the sum of ₹25,000/- with two sureties in the like amount to the satisfaction of the Arresting Officer/SHO concerned. Further, subject to the condition that the petitioner would join the investigation, as and when directed and will not leave the country without the permission of the court concerned and in case of change of his residential address, he will inform the same to the Court concerned by filing an affidavit.
