% 03.11.2017 CM No.39526/2017 (for exemption) 1.
Allowed, subject to just exceptions.
2.
The application is disposed of.
CM(M) 1243/2017 3.
This petition under Article 227 of the Constitution of India impugns the order [dated 13th September, 2017 in TP(C) No.118/2017 of the Court of District & Sessions Judge, District Central, Tis Hazari Courts, Delhi] of dismissal of the petition filed by the petitioner for re-transfer of his suit transferred, the counsel for the petitioner informs to the Court of ADJ-09, District Central, Tis Hazari Courts, Delhi, back to the Court of ADJ-13 in the same district.
4.
The counsel for the petitioner on enquiry states that the suit was earlier pending in the Court of ADJ-13 but was transferred to the Court of ADJ-09.
5.
The basis of the re-transfer sought was that the final arguments in the suit were part heard before the learned ADJ to whose Court the suit was sought to be re-transferred.
CM(M) 1243/2017
6.
The counsel for the petitioner is however blissfully unaware as to the reason of transfer.
7.
Without knowing the reason for transfer, re-transfer cannot be sought. Dismissed.
No costs.
