% 01.02.2018 Learned counsel for the petitioner alleges non-compliance of the order dated April 27, 2017 passed in W.P.(C) 3472/2017. It is his submission that as per the website of the NCTE, the Appeal Committee shall hold its proceedings on 1st February, 2018 (today), 2nd, 3rd and 5th February, 2018. On the other hand, learned counsel appearing for the respondents states, as per her instructions, the Appeal Committee shall hold the proceedings in 3rd / 4th week of February 2018. Noting the submissions made by the learned counsel for the parties, I deem it appropriate, to direct if the Appeal Committee holds its
proceedings/meetings on 3rd, 4th and 5th February, 2018, the case of the petitioner shall be placed before the committee for consideration on those dates, if in the eventuality, the Appeal proceedings are not to be held on those dates, then the case of the petitioner shall be considered in the proceedings to be held in the 3rd / 4th week of February, 2018. The decision taken by the Appeal Committee shall be communicated to the petitioner as expeditiously as possible.
In view of the above, the contempt case is disposed of. If the petitioner is still aggrieved because of the non-compliance of the order dated April 27, 2017, the petitioner shall be at liberty to revive the contempt proceedings.
